Building complete and final inspections complete. Collier County Growth Management Refereed us to DBPR to obtain state waiver. We have approval and waiver from Collier County growth management to remove the elevator.

Requirements to be Waived.

9. Requirements requested to be waived. Please reference the applicable section of Florida law. Only Florida-specific accessibility requirements may be waived.

Issue 1: Florida-specific hotel/motel rooms Minimum height in parking structures Accessible parking
Vertical accessibility Toilet rooms
Private Other Because ADA standards for Accessible design gives exceptions which do not require vertical accessibility to upper floors of buildings less than three stories and because the proposed design exceeds the required number of accessible rooms (as outlined in the same standards) by placing them all on the lower level, we would request that the Florida requirements be waived down to the requirements of the ADA standards. This would eliminate the need for an elevator.

Grounds for waiver.

10. Grounds for Waiver: The Florida Building Commission may grant waivers of Florida-specific accessibility requirements upon a determination of unnecessary, unreasonable or extreme hardship. Please describe how this project meets the following hardship criteria. Explain all that would apply for consideration of granting the waiver.

NOTE:**

We, 808 Wiggin's Pass Road LLC, was told by the Collier County Building Department that a elevator was not required and our plans were approved without the elevator. We built the building according to the plans and have had all Life safety and all other building inspection completed satisfactorily. Now the Collier county building department says that we need this waiver from the State of Florida.

This building project started prior to Hurricane Irma. As you can imagine, the hurricane created all kinds of problems for the local building industry. We have been trying to complete this building for two years. We are completely out of money and have no way to pay for an elevator at this point.

Almost all of our work is done on the computer so we don't need to have visitors. If there was

Please see attached quote for elevator installation, including all additional requirements.
