The Petitioner is requesting clarification whether their product, EPOX-Z
cool roof coating meets the scope of 9N-3.
1) The petitioner is
requesting confirmation that EPOX-Z industrial products (coating, EPOX-Z
Mastic, primer, and adhesive products) are not within the scope of the Product
Approval Rule 9N-3.
Background:
Situation:

The EPOX-Z industrial product is
100% solids and solvent free.

The product is non-structural and
engineered to provide surface protection, one coat ease of application, high
chemical resistance, and adhesion over a wide range of materials.

Provides a highly effective water
repellant barrier as well as chemical and corrosion resistance.

Product is most commonly used on
steel and concrete.

The EPOX-Z Mastic industrial product
is non-structural and designed to bridge void areas where dissimilar materials
are used.

The EPOXY-Z Mastic are used to
repair decking, vertical cracks, and flashing transitions to bricks and mortar

The EPOX-Z industrial primer product
is used for all building materials. This product’s 0.133 permeability rating
mitigates water infiltration throughout all above grade elements of the
building envelope.

9N-3.001 Scope:
(2) This rule applies to
approval of products and systems, which comprise the building envelope and
structural frame for compliance with the structural requirements of the Florida
Building Code.
9N-3.002: Definitions:
(31) Structural component means
any part or assembly of buildings that comprises the main wind force resisting
system and components or cladding.
(33) Subcategory of product or construction
system means a specific functionality:
(d) For roofing products: built
up roofing, modified bitumen roof system, single ply roof systems, spray
applied polyurethane roof system, roofing fasteners, roofing insulation,
asphalt shingles, wood shingles and shakes, roofing slate, roof tile adhesives,
cements-adhesives-coatings, liquid applied roof systems, underlayments, metal
roofing, roofing tiles, waterproofing, roofing accessories that are an integral
part of the roofing system and products introduced as a result of new
technology;

Question: Do the abovementioned
EPOX-Z industrial products fall within the scope of the Rule 9N-3?
Answer: No. The products in question are an aftermarket
products “maintenance products” which fall outside the scope Rule 9N-3.
