Ø  Objective - The purpose of this meeting is to review and provide recommendations on Declaratory Statements and other business on behalf of the Commission.

 

Meeting Minutes

Objective

Review of objectives will include the following:  Description of issue, discussion by TAC, public comment, TAC action.

1)

Welcome and Opening Remarks. The meeting opened at 10:00am.

2)

Roll Call:  Roll call of the Special Occupancy TAC was conducted with a full quorum present.  It was noted that Special Occupancy Chairman, Jon Hamrick, was absent due to the passing of his father and Charles Frank had a previous meeting scheduled that prevented his attendance. 

Roll call of the Structural TAC was conducted with a full quorum present.  It was noted that Nicholas Nicholson is no longer assigned to the Structural TAC.

Review and Approval of Meeting Agenda: Motion by Cam Fentriss, seconded by Philip Wisely to accept Special Occupancy Agenda as presented.  Motion by Jack Glenn, seconded by Bill Dumbaugh to alter the agenda by reviewing DS2012-081 first, then DS2012-096, DS2012-097 and DS2012-094, respectively for the Structural TAC.  Unanimous approval by both TAC’s.

Review and provide recommendation on Declaratory Statement DS2012-081 Advanced Manufacturing and Power Systems, Inc., Joseph Scofield. 

Staff Analysis. 

Question 1:

Is the generator enclosure required to be tested and approved per Section 1626 of the 2010 Florida Building Code and bear either appropriate Florida Product Approval numbers or Miami-Dade Notice of Acceptance approval?

Answer: As per Section 419.4.2.9.6 of the 2010 FBC, Building “the Code”, the generator enclosure in question must be constructed to meet the structural requirements of the Code and the debris impact requirements of Sections 1626.2 through 1626.4 as applicable.  Further, in order to demonstrate compliance with the debris impact requirements of the Code, the generator enclosure or its components must be either tested to TAS 201, 202, and 203 in accordance with the requirements of Sections 1626.2 and 1626.3 as applicable or designed/constructed to meet the deemed to comply standards of Section 1626.4 as applicable. Product approval of the enclosure in question as meeting the debris impact requirements of the Code is subject to the review and discretion of the authority having jurisdiction.

Special Occupancy - After full review of request for declaratory statement and hearing staff analysis, motion by Wayne Young, seconded by Scott Cannard to accept the staff recommendation.  Vote: unanimous to accept.

Structural TAC: motion by CW Macomber, seconded by Jamie Gascon to accept staff recommendations.  Vote: unanimous approval.

 

Question 2:

Is the generator enclosure required to be tested and approved per Section 1626 of the 2010 Florida Building Code and bear either appropriate Florida Product Approval numbers or Miami-Dade Notice of Acceptance approval?

Answer: As per Section 420.4.2.9.6 of the 2010 FBC, Building “the Code”, the generator enclosure in question must be constructed to meet the structural requirements of the Code and the debris impact requirements of Sections 1626.2 through 1626.4 as applicable.  Further, in order to demonstrate compliance with the debris impact requirements of the Code, the generator enclosure or its components must be either tested to TAS 201, 202, and 203 in accordance with the requirements of Sections 1626.2 and 1626.3 as applicable or designed/constructed to meet the deemed to comply standards of Section 1626.4 as applicable. Structural TAC – Motion by Jack Glenn, seconded by Steve Strawn to accept staff recommendations.  Vote: unanimous approval.

Special Occupancy: motion by Wayne Young, seconded by Scott Cannard to accept staff recommendations.  Vote: unanimous approval.

 

Question 3:

Is the generator enclosure required to be tested and approved per Section 1626 of the 2010 Florida Building Code and bear either appropriate Florida Product Approval numbers or Miami-Dade Notice of Acceptance approval?

Answer: According to Section 423.25.5 of the 2010 Florida Building Code, Building (the Code); the generator enclosure or its components is required to be designed to protect the generator from wind and missile impact and thus the generator enclosure or its components must be tested and approved as meeting the impact requirements of Section 423.25.4.1 of the Code.

Structural TAC: Motion by Steve Strawn, seconded by Jaimie Gascon to accept staff recommendations.  Vote: unanimous approval.

Special Occupancy TAC: Motion by Scott Cannard, seconded by Wayne Young to accept staff recommendations.  Vote: unanimous approval.

 

Question 4:

Is the generator enclosure required to be tested and approved per Section 1626 of the 2010 Florida Building Code and bear either appropriate Florida Product Approval numbers or Miami-Dade Notice of Acceptance approval?

Answer: Option #2: Yes. The enclosure in question is “part of” a building which must be constructed to meet the structural requirements of the Code and the debris impact requirements of Sections 1626.2 through 1626.4 as applicable.  Further, in order to demonstrate compliance with the debris impact requirements of the Code, the generator enclosure or its components must be either tested to TAS 201, 202, and 203 in accordance with the requirements of Sections 1626.2 and 1626.3 as applicable or designed/constructed to meet the deemed-to-comply standards of Section 1626.4 as applicable. Product approval of the enclosure in question as meeting the debris impact requirements of the Code is subject to the review and discretion of the authority having jurisdiction.

Structural TAC: Motion by Rusty Carroll, seconded by Strawn to accept option #2 of staff recommendations and to add the verbiage, “part of”.  Vote: unanimous approval.

Special Occupancy TAC: Motion by Cam Fentriss, seconded by Frank Frail to accept option #2 of staff recommendations and to add the verbiage, “part of”.  Vote: unanimous approval.

 

Question 5:

Is the generator enclosure required to be tested and approved per Section 1626 of the 2010 Florida Building Code and bear either appropriate Florida Product Approval numbers or Miami-Dade Notice of Acceptance approval?

Answer: Option #2: Yes. The enclosure in question is a building which must be constructed to meet the structural requirements of the Code and the debris impact requirements of Sections 1626.2 through 1626.4 as applicable.  Further, in order to demonstrate compliance with the debris impact requirements of the Code, the generator enclosure or its components must be either tested to TAS 201, 202, and 203 in accordance with the requirements of Sections 1626.2 and 1626.3 as applicable or designed/constructed to meet the deemed-to-comply standards of Section 1626.4 as applicable. Product approval of the enclosure in question as meeting the debris impact requirements of the Code is subject to the review and discretion of the authority having jurisdiction.

Structural TAC: Motion by Rusty Carroll, seconded by Steve Strawn, to adopt option #2 as recommended by staff.  Vote: unanimous approval.

Special Occupancy: Motion by Frank Frail, seconded by Cam Fentriss to adopt option #2 as recommended by staff.  Vote: unanimous approval.

5)

Review and provide recommendation on Declaratory Statement DS2012-097 petitioned by URETEK Holdings, Inc., Robert W. Moody, Jr.  Supporting document: DIPatent.

Question 1:

Is the installation of a rigid structural geotechnical polymer into the ground as a method of

soil stabilization for an existing building prohibited by the 2010 Florida Building Code,

Residential, Chapter 3, Code Section R318.5?

Answer:  No.  The provisions of Section R318.5 of the FBC, Residential do not apply to the projects in question.

Question 2:

Are soil stabilization techniques as discussed herein regulated by 2010 Florida Building Code –

Residential and/or Existing Building?

Answer: The applications of the soil stabilization techniques in question fall within the technical scope of the 2010 Florida Building Code, Existing Building and not the Florida Building Code, Residential.

Structural TAC: Motion by Jack Glenn, seconded by C.W. Macomber, to accept staff recommendations on questions 1 and 2, together.  Vote: unanimous approval.

Special Occupancy TAC: Motion by Cam Fentriss, seconded by Frank Frail to accept staff recommendations on questions 1 and 2, together.  Vote: unanimous approval.

 

6)

Review and provide recommendation on Declaratory Statement DS2012-096 petitioned by the City of Ocala.

Question 1:

Does  injecting this pressurized structural polyurethane resin for soil stabilization thru the slab on grade for existing dwellings, with possible direct contact with the concrete slab on grade, constitute a violation of 2010 FBC-R Section 318.5?

Answer: No.  The application of Section R318.5 of the FBC, Residential is limited in scope to new construction.

Question 2:

Does injecting this structural polyurethane resin into the ground outside the existing dwelling unit with possible direct contact with the foundation/footer constitute a violation of 2010FBC-R 318.5? 

Answer:  No. The provisions of Section R318.5 of the FBC, Residential do not apply to the projects in question.

Structural: Motion by Jack Glenn, seconded by Steve Strawn, to accept staff recommendations on Questions 1 and 2, taken up together.  Vote: unanimous approval.

Special Occupancy TAC: Motion by Cam Fentriss, seconded by Frank Frail to accept staff recommendations on Questions 1 and 2, taken up together.  Vote: unanimous approval.

 

This ended the concurrent portion of the meeting and the Special Occupancy TAC adjourned at 11:29am.

 

7)

Structural TAC to review and provide recommendation on Declaratory Statement DS2012-094, by Joe Hetzel of DASMA.

Question 1:  Does the term “protection of openings” mean the same as the term “opening protection”, as found in the text of the referenced section, and specific to “protection from windborne debris”?

Answer: Yes, the term “protection of openings” is analogous to the term “opening protection” as referenced in Section 1609.1.2 of the 2010 Florida Building Code, Building and specific to “protection from windborne debris.”

Question 2:  Is the non-glazed door required to comply with Section 1609.1.2?

Answer: No, Section 1609.1.2 is specific to glazed products.

Question 3: If the non-glazed door is not required to comply with Section 1609.1.2, but it complies with the wind load requirements of the code, would the door also comply with the code as “opening protection”?

Answer: A non-glazed door is not required to be protected in accordance with Section 1609.1.2 in a non-HVHZ zone.

Question 4:  Would the state-approved, glazed garage door rated for non-HVHZ impact resistance be acceptable for the job (which is outside the HVHZ) without an NOA?

Answer: Yes, if used as per the limits of use of the Product Approval.

Structural TAC: Motion by Steve Strawn, seconded by Jack Glenn to accept staff recommendations on all four questions.  Vote: unanimous approval.

Other Commission business: There was no other business to be conducted on behalf of the Commission.

Member Comment: Several TAC members thanked staff for their work in preparing for this meeting.

Schedule next meeting: Next meeting will be in conjunction with the Commission meetings to be held in St. Augustine, Florida, April 8-9, 2013.  Actual date/time to be determined.
