Description:
Restaurant in an historic building, part of which has two stories. Second story is small portion of entire space (18%). Everything the restaurant offers will be available to everyone on the first floor - nothing unique will be offered on the second floor. It is in a historic building - documentation included herein. No vertical accessibility to second floor - only original staircase.

Local building official has informed us that because of the second floor we need vertical accessibility or a vertical accessibility waiver. There are 4 options: 1) Elevator outside (Historic District Commission will not allow that - see letter); 2) Platform lift next to the staircase, which will require a significant alteration of the second floor and destroy the historical integrity and beauty of the historic building; 3) Chairlift going up the staircase, which will both destroy the historical integrity of the building and the will limit egress for non-handicapped folks (Fire Marshall will not allow that); 4) An accessibility waiver (Historic District Commission and building department support this solution).

Accessibility to the second floor of the restaurant is required by the Florida Accessibility Code for Building Construction. The law also allows for waivers to be granted for various reasons, including historical preservation. I am seeking a waiver from the vertical accessibility requirement due to the significant negative impact on the historic building in which my restaurant will be located. I have and will ensure access for all people to all food, drink, and services of the restaurant on the first floor. I am committed to continuing the historical preservation of this important building to Fernandina Beach's history.
