Issue:  Inclusion of lavatory sink inside the accessible toilet stall

Analysis:  The applicant is requesting a waiver from the requirement to place a lavatory sink in every Accessible toilet stall. The existing restrooms predate Accessibility requirements, and accessible stalls will be created by removing adjacent fixtures.  Walls surrounding these restrooms are structural, and the restrooms cannot be expanded.  Even with removing fixtures, the new stalls allow room for floor clearance at the toilet, but not enough for adding lavatories.  Accessible lavatories are available in the restroom, outside of the stall.

Inclusion of lavatory sink inside the accessible toilet stall.

213.3.1 Toilet Compartments. Where toilet compartments are provided, at least one toilet compartment

shall comply with 604.8.1. In addition to the compartment required to comply with 604.8.1, at least

one compartment shall comply with 604.8.2 where six or more toilet compartments are provided, or where the combination of urinals and water closets totals six or more fixtures.

 

604.8.1 Wheelchair Accessible Compartments. Wheelchair accessible compartments shall comply

with 604.8.1.

 

604.8.1.1 Size. Wheelchair accessible compartments shall be 60 inches (1525 mm) wide minimum

measured perpendicular to the sidewall, and 56 inches (1420 mm) deep minimumforwall hungwater

closets and 59 inches (1500 mm) deep minimum for floor mounted water closets measured perpendicular

to the rear wall. Wheelchair accessible compartments for children’s use shall be 60 inches

(1525 mm) wide minimum measured perpendicular to the side wall, and 59 inches (1500 mm) deep

minimum for wall hung and floor mounted water closets measured perpendicular to the rear wall.         

 

Waiver Criteria:  There is no specific guidance for a waiver of this requirement in the code.  The Commission’s current rule, authorized in Section 553.512, Florida Statutes, provides criteria for granting waivers and allows consideration of unnecessary or extreme hardship to the applicant if the specific requirements were imposed.
