6)

Review and make recommendation to the Commission regarding:

DS2014-043, petitioned by City of Oviedo, Donald L. Fuchs, Jr.

Mr. Fuchs provided a brief statement as to request for declaratory statement.  Staff analysis was provided by Mo. Madani which included an overview of the original request for declaratory statement, and a modification to the original question to include a change in one word in the question which the Fire and Electrical TAC’s voted on as modified.  The modified question is, “Since the townhouse unit is considered a single-family dwelling unit, with a zero lot line, must each townhouse unit have their own separate utilities including electric, fire sprinkler system if required, and water sewer service within their own property building?”  Mr. Madani provided the decisions as voted upon by the Fire and Electrical TAC’s which states, “Yes, the building should be treated as a separate building pursuant to R302.2 of the Florida Building Code-Residential volume”   In summary, staff concluded that each building should be treated as a separate unit and utilities should be provided to each unit independently.  April Hammonds, legal staff for the Commission advised that, included in this request as statement of fact and ‘legal term of art’ is that these units are “fee-simple” (the owner maintains ownership of the land below and the air space above the property that is owned.

Bill Dumbaugh motioned to respond “Yes” to the question as stated by the Fire and Electrical TAC’s, seconded by Don Brown.  With no further discussion by the TAC, vote was called, with a unanimous vote to approve motion as also approved by both the Fire and Electrical TACs.

8)

Discuss and recommend potential research topics for consideration by the Commission.

Dick Browdy suggested that a state-wide analysis of permitting fees and permitting plan review times and, perhaps other issues, would help evaluate the uniformity of the administration of our ‘uniform (building) code and assist with providing some consistency throughout the different jurisdictions in the administration of the uniform code.  At the very least, provide research and analysis in the districts which provide 75%-80% of the total permits applied for within the state. It was also suggested that perhaps BOAF already has this information or can be a catalyst to obtain this information. There was a workgroup in the recent past which reported that there is a major disparity in the permitting fees and time schedules to apply for and obtain permits but nothing was moved forward based on that report.

None of the TAC members made a motion to move this forward for a vote.
