Description:
Reconstruction of 24 apartment units which were part of a pre-existing 144 unit multifamily residential complex built in 1971. The 24 units were contained in a two story walk up building that was destroyed be fire in May 2017. The multifamily residential complex is privately owned and financed. The building will not have any public/common areas.

The design phase has stalled as the Temple Terrace building officials have indicated that a vertical lift may be required. The Temple Terrace building officials require a waiver from the FBC in order to waive the vertical accessibility requirement.

The proposed re-construction of the multifamily residential building is only two stories and does not include and elevator. Under the ADA, the proposed subject development is exempt as it is less than three stories. Under the Fair Housing Act, the proposed subject development is not considered a "covered multifamily dwelling" as it does not include an elevator and therefore, not regulated by the FHA. Under the Florida Fair Housing Act (Florida Statutes), the proposed subject development is also not considered a "covered multifamily dwelling" and therefore, not required to have an elevator or lift. Finally, under the Florida Accessibility Code for Building Construction, the proposed subject development, being less than three (3) stories, is exempt from the requirement of a vertical lift.
