NOTE:**
Vertical Accessibility in Existing Buildings, Alterations Section 202.3 contains an exception we interpret as very clearly applying to this project is Exception #1:
"1. Unless required by 202.4, where elements or spaces are altered and the circulation path to the altered element or space is not altered, an accessible route shall not be required."
In our case, the circulation path to the altered 2nd floor space is not being altered in any way, therefore no accessible route TO the 2nd floor is required. Exception #1 appears to be written exactly and specifically for the condition that we are proposing.
Section 202.4 describes "Primary Function Areas" such as bathrooms, drinking fountains, etc. that are all being provided on the 1st floor.

The addition of an elevator shaft, machine room, electrical capacity and elevator system will add significant cost to the project well in excess of 20% of the total project cost. Additionally, because the building is identified as a Historic Structure by the City of Miami beach, the addition of an elevator and shaft would be a lengthy, expensive and time consuming endeavor to get approved.
