F.S.553.512 Modifications and waivers, advisory council.- The Florida Building Commission shall provide by regulation criteria for granting individual modifications of, or exceptions from, the literal requirements of this part upon a determination of unnecessary, unreasonable, or extreme hardship, provided such waivers shall not violate federal accessibility laws and regulations and shall be reviewed by the Accessibility Advisory Council.
We believe that we qualify under the "unreasonable, or extreme hardship" per 553.512...."if an applicant for a waiver demonstrates economic hardship in accordance with 28 C.F.R. s. 36.403(f) (1), a waiver shall be granted"

399.02 Elevator Safety (8)The division may grant variances for undue hardship pursuant to s. 120.542
s.120.542 (2) Variances and waivers shall be granted when the person subject to the rule demonstrates that the purpose of the underlying statute will be or has been achieved by other means by the person and when application of a rule would create a substantial hardship or would violate principles of fairness. For purposes of this section, "substantial hardship" means a demonstrated economic hardship to the person requesting the variance or waiver.
