TAC Objectives

Code Administration TAC Members Present: Chairman; Herminio Gonzalez, Dick Browdy, Don Brown, Tim Tolbert, John O’Connor, Hamid Bahadori, Bob Boyer, Jay Carlson, Bill Dumbaugh

Code Administration TAC Members Absent: None

Objective – To consider and discuss two requests for declaratory statement, DS 2013-103 by James Scott of J. Scott Drafting, Inc. and DS2013-089 by Timothy Krebs of T.A. Krebs, LLC and to provide recommendations for consideration by the Commission.

Review of objectives will include the following:

Welcome and Opening Remarks. Meeting opened at 2:00pm.

Roll Call was taken and a quorum was present.

Review and Approval of Meeting Agenda

Motion was made by Bob Boyer and seconded by Tim Tolbert to approve the meeting agenda as posted.

4)

Review and Approval of Meeting Minutes of October 9, 2013.  Motion was made by Bob Boyer and seconded by Herminio Gonzalez to accept previous meeting meetings with no changes or alterations.

5)

Review and provide recommendation on request for Declaratory Statement DS2013-103 by James Scott of J. Scott Drafting, Inc.     Staff Analysis

Petitioner, James Scott, was not present for the meeting.  Mo Madani provided overview and staff analysis for the request for Declaratory Statement.  After discussion by the Code Administration TAC and general public, motion was made by Dick Browdy, seconded by Herminio Gonzalez, to accept the staff recommendation with minor modification as follows:

To the question: For the building containing structural elements exceeding the FBC-R limits or otherwise nonconforming to the code, but designed in accordance with the accepted engineering practice, does the FBC-R require the complete set of plans and specification to be certified by an Architect or Engineer as being designed to comply with the structural portion of the Building Code for wind and gravity loads?

 

The answer is: According to Section 107.1 of the 2010 FBC, Building, determination of whether a set of construction documents is required to be certified by an architect or engineer is subject to the provisions of Section 107.1 and Chapters 471 or 481 of Florida Statues as applicable.  (Note: the petitioner should be advised to contact the State Board of Architecture and Interior Design, or the Florida Board of Professional Engineers regarding this matter.)

Review and provide recommendation on request for Declaratory Statement DS2013-089 by Timothy Krebs of T.A. Krebs, LLC.    Staff Analysis

Mr. Tim Krebs was present to provide overview of the request for declaratory statement.  Mo Madani provided the staff analysis.  Jack Glenn and Jamie Gascon supported the staff analysis which references the Florida Building Code, Existing Building volume as it serves as a map or guide as to where to seek details to meet code compliance within the body of the Florida Building Code. 

 

After discussion, Bill Dumbaugh provided a motion, seconded by Tim Tolbert, to accept the staff analysis as a recommendation to the Commission.  Roll call vote was taken:

All Code Administration TAC members voted in favor of the staff analysis, with one exception, John O’Connor, who voted “NO”.  Motion passes.

Question:

To the question: Is the applicant for a single family residence remodeling/addition complying with FBC-Residential required to demonstrate compliance with the FBC-Existing Buildings?

The answer is: Yes. According to Section R101.2 Exception 2 of the 2010 Florida Building Code, Residential, Existing buildings undergoing repair, alteration or additions, and change of occupancy shall comply with the Florida Building Code, Existing Building.
