Code Administration TAC:
1. The committee reviewed and approved agenda and minutes. The meeting was chaired by George Wiggins. The following members were present: Dick Browdy, Herminio Gonzalez, Hamid Bahadori, Matt Carlton, John O'Connor, and Bill Dumbaugh. Staff attending were Mo Madani, Rick Dixon, Jeff Blair, Joe Bigelow, and Betty Stevens
2. The committee reviewed and provided recommendations to the Commission on the request for declaratory statement DCA08-DEC-142 by Jerry Sparks, Director, Hillsborough County Building Services Division, Planning and Growth Management Department. The committee went with the staff recommendation.
Question #1: Whether Sections 110.2 and 106.3 in conjunction with F.S. Chapter 163 allow a local government to restrict the issuance of Certificate of Occupancy to enforce compliance of off-site improvements conditions.
Answer: As per ss. 110.2 and 106.3 of the Florida Building Code, Building, withholding Certificate of Occupancy is explicitly authorized for other than code subjects i.e. enforcement of other laws and ordinances enforced by the Hillsborough County Building Department. However, the Florida Building Commission jurisdiction is limited in scope to subject matters authorized under Chapter 553, Florida Statutes.
Question #2: Whether it can also be withheld to enforce compliance of on-site improvements conditions, all to meet adopted land development regulations.

3. The committee reviewed and discussed proposed code changes to Chapter 1 of the FBC, Building and provide recommendation for consideration. Mod # 2862, 2863, 3223, 2882, 2936, 2929, 2939, 3176, 2930, 2932, 2933, 3011, 3174, 2934, 3127, 3221, 3144 4. There was no new business. 5. The committee adjourned 11:00 A.M.
