Amendment to Petition for Declaratory Statement by Richard Mihalich Dated April 28, 2010
The purpose of this amendment is to clarify the circumstances
bringing about the request for a declaratory statement.
The townhome in question was constructed in 1984 and has a flat
roof system. The rectangular townhome
roof has a surrounding parapet on all four faces. Each of the parapet faces has an opening with
gutters to facilitate drainage of the roof.
Puddles exist on the roof after precipitation has ceased and, if not for
evaporation, the puddles would remain indefinitely. The conditions of the existing roof covering
and underlying roof structure allow the roof to be recovered as stated in
Section 1510.3, Florida Building Code and Section 611.3, Florida Building Code,
Existing.
The townhome is proposed to be reroofed using a modified bitumen
roofing system as defined in Section 1507.11, FBC. Section 1507.11.1, FBC, states that the roof
shall have a minimum design slope of one-fourth unit in twelve.
Section 1510.1 FBC and Section 611.1, FBC, Existing; both have
exceptions to the required one-fourth unit in twelve minimum slope requirements
for roofs that provide positive roof drainage.
Do the conditions of the townhome, as stated above, constitute Positive
Roof Drainage as defined in Section 1502, Definitions, FBC, thereby
allowing the roof to be recovered as opposed to being replaced and the required
minimum one-fourth unit in twelve slope installed?
