Discussion – The Chair asked the Education Administrator
if the type of change that occurred within the self-affirmed course materials
could be listed with the rest of the course information so POC Members would
know why a particular course qualified as self-affirmed. The Education
Administrator stated that he would add, in general terms, the change made for
self-affirmed courses from this point forward.

7. Discuss the difference in access between the
Education POC members and the general public, regarding the review of training
course materials located in the Building Code Information System (BCIS)
The Chair stated that Jack
Glenn made some comments about this issue at the last Commission meeting---and
would like Jack to repeat those comments for the POC members.
Jack said that a few years
ago he had a PowerPoint presentation stolen from its posting on the internet.
He further said that he prefers that a notice of some kind be posted on the
BCIS which reinforces the intellectual property rights of the training
materials.
Jim Richmond stated that the
training materials do have to be available for the public to view, but that it
is legal to restrict certain fields on the BCIS. To make up for the
restrictions, Jim stated that the public may make a written public records
request to DCA staff to provide a copy of the training materials. Ila Jones
stated that to this point, she is not aware of anyone ever asking for a copy of
a training course, or of training materials.
Cam stated that a disclaimer
can be posted on the BCIS to not only include how to request a copy, but to
also state that this information is proprietary and that the person must have
permission of the owner if they want to use the information in any way. Larry
Schneider stated that AIA posts copyright at the beginning of all materials.
The Chair stated that he
agreed with what Cam suggested, to post a disclaimer regarding intellectual
property rights and referencing relevant laws as to the use of the materials.
The Chair asked if this task could be handled by DCA staff. Ila stated that Jim
Richmond would need to draft the appropriate language.
Jim Richmond stated that he
could construct a boiler plate letter covering this issue of intellectual
property rights, to be posted on the BCIS. Jim further stated that this could
be accomplished without rulemaking. The Chair agreed that he would like this
done administratively versus through the rulemaking process.

November 10, 2010, we have 112 training providers and 12 accreditors
Discussion – The Chair asked Cam Fentriss to give some
background information regarding training course evaluations. Cam stated that
this discussion started with the idea of possibly placing an evaluation form on
the BCIS to be used by providers as a source to evaluate their courses. She
also stated that as part of this discussion, Jim Richmond had stated that the
use of any Commission sponsored evaluation form should be voluntary---not
mandatory. If a form was mandatory, then it would have to be written into rule,
which everyone agreed they did not want to happen.
Larry Schneider stated that
the Board of Architecture and Interior Design provides a standard course
evaluation form that everyone uses and seems to be ok with. He thinks that the
various boards should handle course evaluations, not the Commission.
Commissioner Hamrick also
stated that the Commission should not become involved with course evaluations.

10. General public
comment
The Chair asked if there
were any public comments.
Larry Schneider stated that
he thinks that the Fla. Accessibility Code will be changing as a result of this
legislative session. He felt, because of these probable changes, that it might
be a good idea that a reminder (letter or email) be sent to providers who teach
the Accessibility Course to re-submit their respective courses for
re-accreditation. Everyone else thought that would be a good idea.
Cam Fentriss stated that the
Education Administrator would do this and asked Larry to send her what
information he felt relevant for this notice. Larry agreed to send the
information after the meeting.
Jack Glenn stated that he
will take the three courses he developed regarding major code changes “on the
road”, starting in mid-May. There will be no charge to attend any of these
courses. Jack further stated that he will be sending a blast email to all of
the boards regarding times and locations.
