Description: 
A business occupancy building at an existing Tampa Electric secure operations center located in Hillsborough County. The functional areas located at ground level within the building include offices, meeting rooms, and training rooms, as well as a mezzanine and balcony included within the lobby dedicated to the development of skills required for line workers to observe and perform all tasks related to electric delivery.

The vertical accessibility component has been reviewed by local building officials, and a vertical accessibility waiver review was recommended as the local authority having jurisdiction would not be able to provide a determination on this matter.

A request for Fl vertical accessibility requirements to be waived down to compliance with ADA Standards of the proposed mezzanine are being requested for consideration based on the following FL Statute:

F.S.S. 553.509(2) Vertical accessibility. However, buildings, structures, and facilities must, as a minimum, comply with the Americans with Disabilities Act Standards for Accessible Design.

Furthermore, provision 28 CFR part 36 Subpart D § 36.401(d)(2) New construction - elevator exemption 2 would apply; thus, an elevator is not required based on the facility being less than three stories.

ADA 28 CFR part 36 Subpart D § 36.401(d)(2) New construction – Elevator Exemption. This section does not require the installation of an elevator in a facility that is less than three stories.
