1. The agenda was approved. The minutes were approved as is.
Attendees: Ed Carson, Craig Perrino, Chris Schulte, Nan Dean, Herminio Gonzalez, and
Do Kim.
2. Update on the Prototype Buildings Program:
ARA provided status report. In this report Mr. York stated the following: Di Vosta has submitted a total of 82 use requests and the “system” is working well. As a result of the January meeting with the City of Cape Coral and Lee County Building Departments, and the Lee Building Industry Association, he is scheduling a meeting with a local builder for consideration of the Prototype Program. Mr. York also stated that he continues to work with several residential and one commercial builder to get them active in the Prototype Program. Further participation is expected after he publishes the DiVosta/Indian River County success story. At the conclusion of the report Mr. York requested an extension of the Applied Research Associates, Inc. contract. There are two one year extensions left on the contract. Product Approval Program Issues. The Committee took an action to recommend to the commission that ARA's contract be extended for an additional year.
B . Discussed and provided recommendations for the following request for
Declaratory Statement:
DCA06-DEC-094 by James V. Miller, QMJ Security Solutions.
ISSUE: DCA06-DEC-094. The Petitioner is requesting clarification regarding Rule 9B- 72 regarding product test reports. Question: Can a Testing Lab test a product and make a test report available to other manufacturers of the same product to use as their own?
Answer: No. Test Lab is functioning as both a test lab and a manufacturer. The test lab is unable to demonstrate independence from the manufacturer. The POC tabled action on this DEC until the next meeting, requesting that the petitioner be present to provide clarification and answer concerns of the POC members. Review product approval and entity applications . The committee considered and took action on all the product applications as presented by A&A staff. There were three entity applications submitted to the Commission for approval. Force Engineering & Testing, Inc. - Approved IRT-ARCON, Inc. - Approved Testing Evaluation Laboratories, Inc. – Approved
4. Other Business:
- A&A asked for contract extension, and the committee recommended that the commission grant A&A a one year extension to the existing contract.
- C-Buck Engineering requested that private labeling application be discussed at the next meeting.
5. Adjourned at 10:28 AM Commission Action Needed :
1. The POC recommends that the Commission grants ARA's contract be extended for an additional year.
2. The POC recommends that the Commission grants A&A's contract be extended for an additional year.
3. Recommend that the products reviewed for approval, conditional approval, deferral, and denial be approved.
