Fire TAC Members Present: Jim Goodloe; Chairman, Pete Schwab, Joe Belcher, Hamid Bahadori, Brad Schiffer, Jon Hamrick, Tony Apfelbeck, Jim Schock.

 

Fire TAC Members Absent: Joe Holland, Jeff Gross, Dale Greiner.

 

Guests Present: Gary Harrison; Petitioner.

 

Staff Present: Mo Madani, Marlita Peters, Joe Bigelow, Jim Richmond.

Mo Madani, with the approval of Chairman’s Goodloe opened the meeting at 2:01pm.  Roll was called and a quorum was present for TAC.   Jon Hamrick called for motion to approve the Fire TAC agenda, seconded by James Schock.  Agenda was unanimously approved with no changes.

Jon Hamrick called for motion to approve the Fire TAC minutes of January 20, 2010, seconded by Peter Schwab.  Minutes were unanimously approved with no changes.

Joe Belcher called for motion to approve the Fire TAC minutes of January 26, 2010, seconded by Jon Hamrick.  Minutes were unanimously approved with no changes.

DEC-146 by Gary Harrison, Building Official of Collier County

Mr. Madani opened the floor to Mr. Gary Harrison, petitioner, to provide a summary of the request for declaratory statement.  Mr. Madani then provided the synopsis of the staff analysis.

 

After discussion among the TAC members, Joe Belcher made motion to accept the staff recommendations as stated below, seconded by Hamid Bahadori.  After discussion, vote taken and passed 9-0.

 

TAC action:

Question One: Would these type structures be included in the classification as residential in accordance with FBC 2007 Residential?

 

Answer: Yes.  The structure provides two sleeping (bunk) rooms. See section 310.1.  (Emphasis added)

 

Question Two: If they are considered residential, even though they will be used on a part time basis (2 weeks per year), would they still be required to meet all the criteria as set forth in the code?

 

Answer: Yes. The applicability of the code is not based on how long a structure is occupied. The only buildings or structures exempt from the code are as provided in section 102.2 of the FBC.

 

Question Three: Would the building be defined as living and habitable space i.e. sleeping, eating, and bathing. Heating and sanitation purposes, as set forth in FBC 2007 Residential

 

Answer: Yes.

 

Question Four: If the answer to the above questions is yes, then would it also have to meet all the requirements as set forth in NEC 2008 for residential construction?

 

Answer: Yes. The FBC, Residential Code, Chapter 33 references the NFPA 70 (National Electric Code)

 

 

No other business, public or member comment was made.

Joe Belcher provided motion to adjourn, seconded by Jim Schock.
