This application has been filed with the Commission instead of with the State Historic Preservation Office ("SHPO") because, while part of the hardship grounds for this waiver request is grounded in historic preservation considerations, another part is based on technical infeasibility. While the SHPO has jurisdiction to grant the relief sought when the underlying basis is preservation of the historic character of the building, it does not have jurisdiction to grant relief when the basis is technical infeasibility. The Commission, on the other hand, has jurisdiction to grant waivers on the various grounds set forth in this application.

Owner requests the Council recommend, and the Commission grant, a waiver of the requirement to provide vertical accessibility from the lobby to the raised first floor of the hotel, as set forth in Sec. 553.509, Fla. Stat., and Section 201.1.1 of the Florida Building Code 5th Edition- Accessibility.

10. Grounds for Waiver: The Florida Building Commission may grant waivers of Florida-specific accessibility requirements upon a determination of unnecessary, unreasonable or extreme hardship. Please describe how this project meets the following hardship criteria. Explain all that would apply for consideration of granting the waiver.


NOTE:**


The only available means of providing vertical accessibility from the main lobby to the elevated first floor of the Abbey are (1) an inclined wheelchair lift or (2) moving an existing elevator that is sandwiched between two fire stairs. The first option is technically infeasible because the implicated stair where the wheelchair lift would have to be installed is not sufficiently wide to provide the required means of egress which would be impermissibly encroached upon.

The historic building contains an elevator which provides access from the lobby to the upper levels where all the guest rooms are located. The existing elevator cannot be relocated to provide access to the raised first floor.



If this waiver request is denied, then the raised first floor will not be able to attain a certificate of occupancy eliminating a significant portion of the building from use.
