We are converting the use of two units on ground. The entire building from R-2 occupancy (long term) to R-1 occupancy (short term). We propose to convert two required ground level efficiency units into fully accessible efficiency units. There is a current existing elevator with a platform size of 56"X 39" which doesn't comply w/ the current code for access to level 2&3. All unit doors are currently 36" wide. The back of the elevator shaft backs into a privately owned unit balcony & facade can't be altered.

NOTE:**
All units are privately owned which can't be altered except for 2 required efficiency units that will be converted to ADA @ ground floor and there is an existing non conforming elevator w/a platform size of 56"X 39" to access level 2 & 3.
The one unit owner triggering his change of use would be responsible for the entire cost v.s. all other 44 coop unit owners being assessed their prorated share.
The association would need to purchase the adjacent units @ both levels & retail store available to enlarge the elevator. Market value of both units are $500,000 & for the retail $350,000. The cost of the elevator construction would be $519,580. The total amount would be $1,369,580.
Comments:
All questions previously have been answered by the licensed design professional. There is absolutely no feasible or practical way to comply w/ a larger elevator than currently exists for vertical accessibility, especially that all 45 coop efficiency units are currently owned and occupied and the work would require the purchase of units to accomodate a larger elevator.
