Sections 553.501-553.513, F.S., and the ADA Standards for Accessible Design do not relieve the owner of any building, structure or facility governed by those sections from the duty to provide vertical accessibility to all levels above and below the occupiable grade level regardless of whether the Standards require an elevator to be installed in such building, structure or facility, except for:
1. (1)Elevator pits, elevator penthouses, mechanical rooms, piping or equipment catwalks and automobile lubrication and maintenance pits and platforms.

This is not an issue but hopefully a solution to our waiver request. The salon's 2nd floor at 2,479 SF is much smaller than the 1st floor at 4,995 SF. This means 23 suites on the 1st floor and 11 suites on the 2nd floor. The salon has dedicated a 1st floor suite at no additional costs, for 2nd floor beauticians to use for customers who cannot access the 2nd floor.

The costs to install an elevator / lift would be approximately $66,000.00. This is an additional 42% to the build-out cost of $158,922.00. To incur such a cost would cause substantial financial costs to the extent we would be unable to continue with the build-out. The build-out cost includes new toilet rooms, sidewalks, doors / door hardware, drinking fountains and millwork which constitutes over 20% of accessibility costs in accordance with Florida Building Code - Accessibility, 202.4.1.
