SEPTEMBER 15, 2008 TELECONFERENCE MEETING REPORT

 

MONDAY, SEPTEMBER 15, 2008

Opening and Meeting Attendance

The meeting was opened at 10:00 AM, and the following Commissioners participated:

Agenda Review and Approval

The Commission voted unanimously, 19 - 0 in favor, to approve the agenda as presented including the following objectives:

 

Ø      To Consider Applications for Product and Entity Approval

Ø      To Consider Applications for Education Course and Accreditor Approval

Ø      To Consider Initiating Amendments to Rule 9B-70 Online Forms for the Education Program

Ø      To Consider the Effective Date for the 2007 Florida Building Code

Ø      To Consider Meeting Dates for 2009

 

 

Consideration of Applications for Product and Entity Approval

Jeff Blair presented the committee’s recommendations for product and entity approvals. The results of

product and entity applications may be found in the Product Approval POC report posted to the

Commission webpage.

 

Initiation of Amendments to Rule 9B-70 Online Forms for the Education Program

Commissioner Browdy presented the Education POC’s recommendation that the Commission initiate rule development for Rule 9B-70, to develop amendments for on-line forms for the Education Program.

 

Motion—The Commission voted unanimously, 18 – 0 in favor, to conduct a rule development workshop at the October 2008 meeting, to amend the accreditor, course, and training program on-line application forms.

Applications for Education Course and Accreditor Approval

Commissioner Browdy presented the Committee’s recommendations for course approvals. Following are the

Commission’s actions:

 

Motion—The Commission voted unanimously, 18 – 0 in favor, to approve the following advanced courses for approval: #315, 316, and 317.

Motion—The Commission voted unanimously, 18 – 0 in favor, to approve the following courses as administrative updates: #64.2, 65.2, and 318.

 

 

Effective Date for the 2007 Florida Building Code

Rick Dixon presented DCA staff’s recommendation, that as a result of the storm caused delay in the rule adoption process for Glitch Amendments, the Commission consider delaying the implementation dates of the 2007 Florida Building Code, the 2008 Supplement to the 2007 Florida Energy Code, and the 2008 Supplement to the 2007 Florida Building Code to implement glitch code amendments to March 1, 2009.

 

Following questions and discussion by the Commission, the following action was taken:

Commission Actions:

Motion—The Commission voted unanimously, 18 – 0 in favor, to make the effective date of the 2007 Florida Building Code, the 2008 Supplement to the 2007 Florida Energy Code, and the 2008 Supplement to the 2007 Florida Building Code to implement glitch code amendments, to March 1, 2009.

 

 

Commission Meeting Dates for 2009

Rick Dixon presented DCA staff’s recommendation regarding Commission meeting dates for 2009.

Rick explained that in an effort to conserve funds, DCA staff is recommending that for 2009 the Commission go from seven (7) meetings to six (6). Rick explained that 2009 is an off-code-update year, and six meetings would be sufficient to conduct Commission business.

Commission Actions:

Motion—The Commission voted unanimously, 18 – 0 in favor, to adopt a six-meeting schedule for 2009. Following is the approved schedule for 2009:

February 2, 3 and 4; April 6, 7 and 8; June 8, 9 and 10; August 10, 11 and 12; October 12, 13 and 14; and, December 7, 8 and 9.

 

 

Adjourn

The Commission voted unanimously, 18 – 0 in favor, to adjourn at 10:45 AM.


ATTACHMENT 1

STAFF PROPOSAL FOR THE EFFECTIVE DATE OF 2007 FLORIDA BUILDING CODE

 

Current situation:

 

2007 Florida Building Code without changes to Rule 9B-13 – Energy Code and glitch code changes (December 31, 2008)

 

2008 Supplement to the 2007 Florida Energy Code to implement the 15% increase in energy efficiency for buildings (March 1, 2008) 

 

2008 Supplement to the 2007 Florida Building Code to implement glitch code changes (March 1, 2008)

 

Implementing corrections and changes to important sections and criteria in the Code two months after it takes effect will result in a high potential for confusion and gets away from the Commission’s original intent to avoid major changes between editions of the Code.

 

Staff Recommendation:

Move the effective date for all the three publications to March 1, 2009.

Issue one Supplement to cover the changes to the Energy Code, the other changes directed by legislation, changes necessary for coordination with the Florida Fire Prevention Code and other state agency regulations and the glitch code changes.

 

Glitch code changes:

There are 250 potential glitch code changes. The following are some of the major changes:

 

-           Correct reference sections and correlation issues with the Florida Fire Prevention

            Code

-           Reinstate missing Code text such as requirements for discharge piping and

      water- heater installation in attic.

-           Make town house definition consistent throughout the Code.

-           Correct “zero lot line” and the fire separation requirements in the Residential code

due to unintended omission.

-           Make grease traps/interceptors and public swimming pools provisions consistent with Department of Health Rules.

-           Add provisions to allow for use of aggregate on roofing - directed by law.

-           Incorporate the roofing mitigation techniques – directed by law.

-           Incorporate provisions for carbon monoxide detectors – directed by law.

-           Incorporate changes to Rule 9B-13 (Energy Code) into the FBC – directed by Governor.

-           Correct the wind importance factor for towers – directed by law.

-           Incorporate optional criteria for gable end construction – directed by law.

-           Incorporate pool bonding requirements as adopted by rule – directed by law.
