Product Approval POC Attendees: Ed Carson- Chair, Herminio Gonzalez, Paul Kidwell, Chris Schulte and Do Kim. Commissioner Jeffrey Stone was also present. Staff present: Azhar Khan and Mo Madani. Ted Berman, Product Approval Administrator was also present.

There was a quorum.

1. Agenda and minutes from August 17th were approved as presented.


2. Product Approval Program Issues

 

A. Product Approval and Entities Statistics Report.
Staff presented the current entities and product statistics from inception of the program.

 

B. Product Approval Administrator’s Performance survey

Staff presented to the Committee the Survey Results.

 

3. Declaratory Statements

 

A. DCA08-DEC-168 by Len Terry, President for Omnicrete Development, Inc. [deferred from last meeting]

 

COMMITTEE ACTION:

QUESTION:

            Is Omnicrete exempt from the process to apply for a Florida Product Approval?

 

ANSWER:

State Product Approval is an option to local approval and not a minimum requirement. Products that are not approved at the State level may be subject to approval by the local authority having jurisdiction. No, it does need a Florida Product Approval, either at a local level or the state level. A structural wall system that is constructed to fit specific plans and design is outside the scope of Rule 9B- 72. However, construction systems that use forms to form the wall system on site do fall within the scope of Rule 9B-72.

 

B. DCA08-DEC-257 by Chris Birchfield, VP of Business Development, No-Burn SE, Inc.

 

COMMITTEE ACTION:

QUESTION:

            Do No – Burn products fall within the scope of Rule 9B-72?

 

ANSWER:

No, since the product is not structural, it falls outside the scope of Rule 9B-72. Products that are not approved at the State level may be subject to approval by the local authority having jurisdiction

 

C. DCA08-DEC-258 by David E. Sands, AIA, Owner Bamboo Technologies

 

COMMITTEE ACTION:

QUESTION:

            Do Bamboo Technologies structural Bamboo poles products fall within the scope of Rule 9B-72?

 

ANSWER:

No. The inquiry in question is specific to the material and strength “properties” of the Bamboo poles which falls under category “structural components” and sub-category “materials”. Sub-category “structural components/materials” were removed from Rule 9B-72 during the revision to the Rule and consequently, the product in question will not fall within the scope of Rule 9B-72. Products that are not approved at the State level may be subject to approval by the local authority having jurisdiction.

 

 

D. DCA08-DEC-212 by Jason Padgett, Millwork Information and Training [recommend dismissal]

 

COMMITTEE ACTION:

Staff recommended dismissing this Dec for lack of information and non-response by the applicant. The Committee voted to dismiss it per staff recommendation

 

E. DCA08-DEC-268 by Sandra Gump, Product Manager Fomo Products, Inc.

 

COMMITTEE ACTION:

QUESTION:

            Do Handi Foam Fireblock and Handi Foam spray foam products fall within the scope of Rule 9B-72?

 

ANSWER:

No, since the products are not structural, they fall outside the scope of Rule 9B-72. Products that are not approved at the State level may be subject to approval by the local authority having jurisdiction.

 

4. Ted Berman & Associates Report


A. Review product approval and entity applications

Products as listed in the report were approved under consent.

 

B. Product Approval Applications with Comments.

Applications with comments were discussed and approved, conditionally approved, deferred and denied as listed in the final report.

 

Public Comment – Staff raised the issue regarding the Administrator concern that whether documentation provided to the Administrator by the Product Approval applicant is confidential. The Committee agreed that any documentation provided to the Administrator by the Product Approval applicant is public record. The Committee also suggested that Administrator clarify the above to any applicants as necessary.

 

5. Adjourn

The Committee adjourned at 11.23 a.m.

Actions needed by the Commission:

Product Approval POC:

1. The Committee recommends the products and entities listed in Administrator's report be approved, deferred, conditionally approved or denied as per voted on by the Committee.

2. The Committee recommends FL 8207 for revocation.

3. The Committee recommends that the Commission conduct an investigation for product failure on FL 8843.
