Requirements to be Waived.

9. Requirements requested to be waived. Please reference the applicable section of Florida law. Only Florida-specific accessibility requirements may be waived.

Issue 1: Florida-specific hotel/motel rooms  Minimum height in parking structures  Accessible parking
  Vertical accessibility  Toilet rooms
  Private  Other

Exceptions 1–7 are preempted by Florida vertical accessibility requirements of s.553.509, F.S., as incorporated in section 201.1.1. Florida requirements may be waived down to the ADA Standards requirements.

Advisory 206.2.3 Multi-Story Buildings and Facilities Exception 4. Where common use areas are provided for the use of residents, it is presumed that all such common use areas “serve” accessible dwelling units unless use is restricted to residents occupying certain dwelling units. For example, if all residents are permitted to use all laundry rooms, then all laundry rooms “serve” accessible dwelling units.

Issue 2: Florida-specific hotel/motel rooms  Minimum height in parking structures  Accessible parking

  Vertical accessibility  Toilet rooms
  Private  Other Need Additional Space
Issue 3: Florida-specific hotel/motel rooms  Minimum height in parking structures  Accessible parking

Grounds for waiver.

10. Grounds for Waiver: The Florida Building Commission may grant waivers of Florida-specific accessibility requirements upon a determination of unnecessary, unreasonable or extreme hardship. Please describe how this project meets the following hardship criteria. Explain all that would apply for consideration of granting the waiver.

NOTE:**

The request of this waiver is mainly due to the age of the building and its current standing design. The building was built in 1956 and is located in the historic district of City of Homestead. The construction would be very disruptive to the layout, which is already limited in square footage. There is limited space for vertical accessibility due to the structure having a poured-t concrete 2nd story floor/roof. With that said, all services offered on the 2nd floor will also be offered on the first floor with the same amenities to serve any customer with accessibility needs. Special attention is being paid to ensure that the accommodations on the first floor will be adequate and of no less standards than the service offered on the second story.
