*Briefly explain why the request has now been referred to the Commission.

The local building department requires a waiver for ADA accessibility and referred me to DBPR. Vertical accessibility requirements are not feasible for this project. Parking accessibility is all public & DOT property, therefore there is no private land for parking with this building. Ramps at entry ways into the building have been built.

Requirements to be Waived.

9. Requirements requested to be waived. Please reference the applicable section of Florida law. Only Florida-specific accessibility requirements may be waived.

Issue 1: Florida-specific hotel/motel rooms  Minimum height in parking structures  Accessible parking

  Private  Other

ADA waiver for vertical accessibility to second floor. Costs exceed percentage threshold of overall project cost

Issue 2: Florida-specific hotel/motel rooms  Minimum height in parking structures  Accessible parking

There is no private land around the building that will allow construction of new parking or alteration of current public parking on DOT and Madison Town property.

Vertical accessibility and parking accessibility

Grounds for waiver.

10. Grounds for Waiver: The Florida Building Commission may grant waivers of Florida-specific accessibility requirements upon a determination of unnecessary, unreasonable or extreme hardship. Please describe how this project meets the following hardship criteria. Explain all that would apply for consideration of granting the waiver.

NOTE:**

Need Additional Space

Elevator for vertical lift access exceed 75% of total construction cost making this not feasible for this project. I have included elevator quotes in the attachments. These costs are more than 50% of the total construction cost, plus we would have to hire a contractor for the opening, electrical, plumbing, etc adding 25% or more.
