This request is being brought forward due to numerous plan reviews which identified that handicap access was required at the second level of an existing historic building, built as a church in 1926. The application of requirement to install a lift for second floor access is impractical, requires an inordinate cost, compromises the historic exterior and limits existing first and second floor utilization. Existing construction and location on the lot limit reasonable alternatives. The historic nature of the building and being located in an overlay district further constrains alternatives.

The vertical ADA accessibility lift would also create additional interior modifications that are impractical. This would include providing a landing access path and existing hallways modifications leading to the restroom and making the restroom ADA compliant. The existing construction does not accommodate that modification including limited access to that area. It is an extraordinary measure and triggers additional structural changes. The lower level is ADA accessible and provides the same level of service and facilities as the second level. In terms of ADA accessibility the first level provides more services than the second level. The second level is limited in size, configuration, and access due to its original design and construction in 1926.

10. Grounds for Waiver: The Florida Building Commission may grant waivers of Florida-specific accessibility requirements upon a determination of unnecessary, unreasonable or extreme hardship. Please describe how this project meets the following hardship criteria. Explain all that would apply for consideration of granting the waiver.

NOTE:**



The property is situated on a corner with no option of placing a vertical lift on any side other than the north side. The east, south and west sides are inaccessible for placement. The north side is constrained by existing construction, design, historic nature and interior design. The existing floor plan including stairwells and balconies (limited access walkways) render an internal lift impractical. The possibility of an external life compromises the historic façade and complicates the landing because there is limited walkway access at the only location available for the placement of a lift. The only area available on the exterior is not accessible on the interior.





The only location available for a lift would require extensive steel construction both in the interior and exterior. The exterior placement available is not supported by the historic preservation office due to the compromising of the historic structure’s elevation on the north side (which is the only side available for consideration). The building is located on a corner lot. The only available area is located on the north side. Adjustments to the existing building are not possible.
